1. Acceptance

By accessing or using Shiverbrand ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Shiverbrand is an AI-powered brand identity generator that helps users create brand names, design systems, and export development prompts. The Service includes free and paid tiers.

3. Account Registration

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account
• One account per person — creating multiple accounts to circumvent limits is prohibited
• You must be at least 16 years old to use the Service

4. Free Tier

The free tier includes one brand research pipeline. Generated names, design systems, and exports are yours to use. The free tier is subject to rate limits and usage quotas.

5. Paid Plans

• Paid plans are billed monthly or annually via Stripe
• You can cancel at any time — access continues until the end of the billing period
• Refunds are available within 7 days of purchase if no exports have been generated
• We reserve the right to change pricing with 30 days notice

6. Intellectual Property

• Your content: you own all brand names, design systems, and exports generated through the Service
• Our content: the Service, its design, code, and AI models remain our intellectual property
• AI-generated content: names and copy generated by AI are provided as-is — we do not guarantee trademark availability or uniqueness

7. Prohibited Use

• Creating multiple accounts to bypass free tier limits
• Scraping, reverse-engineering, or automating access to the Service
• Using the Service for illegal purposes or to generate harmful content
• Reselling generated content as a competing brand naming service
• Attempting to circumvent rate limits or security measures

8. Disclaimer

The Service is provided "as-is" without warranties of any kind. We do not guarantee that generated brand names are available as trademarks, domains, or social handles. Users are responsible for conducting their own trademark searches before using any generated name commercially.

9. Limitation of Liability

To the maximum extent permitted by law, Shiverbrand shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability is limited to the amount you paid in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from your Settings page.

11. Governing Law

These Terms are governed by the laws of France / European Union. Disputes shall be resolved in the courts of Paris, France.

12. Changes

We may update these Terms from time to time. Continued use after changes constitutes acceptance.
